WARRANTY DISCLAIMER AND SAFETY PRECAUTIONS

Materials and Workmanship Defects

All AventurasTM surfboards are warranted to be free from original defects in materials and workmanship for thirty (30) days from the date of purchase. All claims must be made within thirty (30) days directly to Aventuras Surf Company or to the retail or ecommerce store where the board was purchased (proof of purchase required). If upon inspection it is determined by Aventuras Surf Company that a defect related to materials or workmanship is present, Aventuras will replace the board with like merchandise at its sole discretion. Aventuras Surf Company reserves the right to settle warranty claims with a like replacement board and will not settle claims by monetary refunds or exchanges. In all cases where Aventuras Boards are used for commercial purposes, such as rentals, surf schools and camps, this warranty is considered null and void. The addition of any third-party parts and/or accessories to the board, such as fins, grips and/or mounts, voids the warranty. Any drilling into or cutting into the board, and/or affixing external objects to it, also voids the warranty. Although Aventuras Boards are manufactured with the highest quality materials and to the highest standards in the industry, because of the unpredictable nature of surfing, Aventuras Surf Company, Inc. does not warrant against damage or breakage of a board which occurs during its use, even if such damage occurs within the thirty (30) day warranty period. Any damage to Aventuras boards resulting from wear and tear, misuse, exposure to the sun, heat or elements, or simply caused by the demands on the board when in use, including but not limited to boards that are heavily damaged, snapped, broken, crushed, compressed, dented, punctured, scraped and fins or straps that are broken or damaged, or any other damage or breakage of any type that is not the result of a materials or workmanship defect, is not covered at any time. Do not use solvents or cleaners on an Aventuras Board. Aventuras Boards are manufactured to last for many years with proper care as detailed above.

 

Safety Precautions

An Aventuras Board should never be used as a flotation, safety or life saving device. If you are not a good swimmer or in any waters which you are unable to safely swim (including areas with dangerous rip currents), do not use your Aventuras Board. Never paddle or surf alone. We strongly recommend and urge adult supervision and caution for use of an Aventuras Board by any persons under the age of eighteen (18) years. Before entering the water, always exercise caution by inspecting for rocks, reefs and other dangerous areas nearby. Be sure to maintain a safe distance from other surfers, boats and vessels at all times while using an Aventuras Board. Aventuras Boards are not intended for sledding or sliding on any surfaces other than water. Aventuras Boards are not pool flotation devices and should never be considered for such use. Keep product away from open flames. We recommend the use of a life jacket when operating or riding an Aventuras Board in all circumstances and in many circumstances, it is required by law.

 

Disclaimer

Surfing is by nature an unpredictable and dangerous activity. As a result, accidents may occur. The purchaser, user and/or their heirs, executors or assignees of this Aventuras Board agree to release and hold harmless Aventuras Surf Company, Inc. and any employees, subsidiaries, related companies, distributors and/or agents of Aventuras Surf Company, Inc. including but not limited to retailer sellers of Aventuras surfboards, from any liability, claims, causes of action and demands of any kind arising from or out of the use of the Aventuras surfboards where such use results in bodily injury, including serious injury, loss of limbs and/or death, or property damage. IN NO EVENT AND UNDER NO CIRCUMSTANCES SHALL AVENTURAS SURF COMPANY, INC., AS WELL AS ITS AGENTS AND RESELLERS, BE LIABLE FOR ANY INDIRECT, INCIDENTAL OR CONSEQUENTIAL DAMAGES ARISING FROM THE SALE OR USE OF THE AVENTURAS BOARD. THIS DISCLAIMER APPLIES BOTH DURING AND AFTER THE TERM OF THE WARRANTY STATED HEREIN. AVENTURAS SURF COMPANY, INC. HEREBY EXPRESSLY DISCLAIMS THE WARRANTY OF MERCHANTABILITY AND FITNESS FOR A PARTICULAR PURPOSE
